About these terms
These Terms & Conditions apply to the website of KPA Accountants, Tax & Business Advisors (“KPA”, “we”, “us”) and to enquiries made through it. Our office is Suite 2, 100 Queen Street, Campbelltown NSW 2560.
The website describes our services and helps you contact us. These terms do not, by themselves, appoint KPA as your accountant or tax agent, authorise a lodgement, or create a paid professional engagement. Any services we agree to provide are governed by the engagement letter and other terms agreed with the client, together with applicable law. An engagement cannot remove rights that the law makes non-excludable.
Website information and individual advice
The information on this website is general and relates to Australian tax and accounting matters. It does not take account of your complete financial position, objectives, tax residency, transaction history or personal circumstances. Examples and preparation lists are introductory, not an exhaustive statement of every rule or document needed.
Tax and superannuation rules change. Eligibility, thresholds, exemptions, deductions and reporting requirements can depend on the year and the facts. Obtain advice on your circumstances before acting or deciding not to act. Contact us if a page appears inaccurate or outdated.
The different services described on this website
- Personal and business taxation: a discussion is needed to confirm the income, entities, years, records and lodgements involved. A possible deduction, refund, concession or tax saving is not a promised outcome.
- Business and accounting: setup, structure, registration, bookkeeping, software and reporting work depend on the agreed scope. A registration service does not guarantee regulatory approval, business performance, finance or a legal outcome.
- Property taxation: rental income, depreciation, expense treatment, ownership changes and capital gains are assessed against the circumstances. These services are not a recommendation to buy, sell, borrow against or invest in a property.
- Self-managed superannuation: administration, accounts and taxation work are distinct from financial product advice. An independent auditor undertakes the annual audit and determines the audit opinion. Accounting preparation is not an audit opinion or assurance that a fund complies.
This website does not offer legal, conveyancing, credit or personal financial product recommendations. Where a matter needs an appropriately authorised adviser, that advice is separate. General references to investments, structures, pensions or funding do not change this distinction.
Enquiries, deadlines and appointments
Sending an enquiry does not mean KPA has accepted the matter, checked a deadline, agreed to act, or booked an appointment. Wait for confirmation of the work, responsibilities and any timing arrangements. For an approaching tax, transaction or reporting deadline, call us and obtain express confirmation; do not rely on an unanswered web enquiry.
Please use the contact form for general enquiries only. To arrange an appointment, use our booking page or contact us by phone or email. Contact the team before sending documents. If the form is unavailable, you can still call or email us. Opening hours describe the office schedule; please call ahead before visiting. No particular response time is guaranteed by the website.
Our appointment booking page uses Calendly. Choose your team member, duration and available time, then complete the booking details. Check that you receive a booking confirmation before treating the appointment as booked. Refer to that confirmation for the meeting details and any rescheduling or cancellation options. Booking a meeting does not create a professional engagement or authorise work.
Engagement, authority, scope and fees
Before professional work begins, the relevant client, services, authority, records, fees and responsibilities need to be agreed. Additional work, including other entities, years, amended returns, reviews or specialist advice, may require a separate scope and fee agreement. Service listings are not fixed-price quotes.
We may need identity and authority checks, conflict checks and information about the person or entity engaging us. Where law requires customer due diligence for a particular service, the necessary checks must be completed before that work can proceed. An enquiry does not imply that every advertised service is appropriate for every client.
Filing or lodging with an authority requires the applicable instructions and authorisations. Your engagement letter sets out payment arrangements, cancellation, record keeping and how either party may end the engagement.
Your information and responsibilities
Provide accurate, complete and timely information and tell us about relevant changes. If acting for a company, partnership, trust, SMSF or another person, you must have authority to give instructions and share their information. Do not submit another person’s confidential material without an appropriate basis.
Clients remain responsible for reviewing information and documents requiring their approval and for obligations that the law places on them. SMSF trustees retain their legal responsibilities even where they use professional assistance. The applicable engagement terms explain the work KPA will undertake; nothing here transfers KPA’s own legal or professional duties to a client.
Privacy and sensitive documents
Our Privacy Policy explains website information handling, enquiries, service-related information, access requests and complaints. It is separate from these terms. Browsing the site or making an enquiry is not blanket permission to disclose your client affairs, send marketing or use information for unrelated purposes.
Do not enter tax file numbers, passwords, bank account details, identity documents, payroll files or other sensitive records into the general enquiry form. Contact the team to agree an appropriate way to provide documents.
Appropriate website use
You may use the website to understand KPA’s services and make genuine enquiries. Do not impersonate others, submit unlawful or misleading material, use it for unsolicited advertising, attempt unauthorised access, introduce malicious code or interfere with its availability. Do not access information you are not entitled to receive.
We may take proportionate steps to protect the website and its users from misuse. This does not give us a right to withhold a statutory remedy or avoid an existing contractual obligation.
Copyright, branding and links
Website text, design, branding and images are protected by the rights of KPA or the relevant owner or licensor. You may view the site and retain reasonable copies for your personal reference, subject to rights allowed by law. Do not present its material as your own or reproduce it commercially without permission.
Names of professional bodies, software providers, regulators and other organisations identify those organisations. A reference or link does not imply that they endorse this website or guarantee a service. Third-party maps, sites and software operate under their own terms and privacy practices.
Availability and external services
We aim to keep the website useful and accurate, but access may be interrupted for maintenance, technical faults or circumstances outside our control. A third-party map, external link or email service may also be unavailable. Please telephone the office if a website feature prevents you from contacting us.
We do not promise that website information will resolve a particular tax or accounting matter. This qualification does not exclude responsibility where Australian law does not allow it to be excluded.
Consumer rights and responsibility
Nothing in these terms excludes, restricts or modifies a consumer guarantee, remedy or other right under the Australian Consumer Law or another law where that would be unlawful. Where consumer guarantees apply to services, they include requirements concerning care and skill, fitness for a disclosed purpose and reasonable timing where relevant.
Your remedies and any liability for website use or professional work depend on the applicable law and any valid, separately agreed engagement terms. Any exclusion or limitation must operate within the law and the valid terms agreed for the particular service. Statutory rights remain available where they cannot lawfully be excluded.
Questions and complaints
Contact tax@kpaaccountants.com.au or call (02) 4626 3050 with a website or service concern. Explain what happened, the relevant dates and the outcome you seek, without sending unnecessary sensitive information. Privacy concerns are addressed in the Privacy Policy complaints section.
You can also contact an appropriate regulator or consumer authority where it has jurisdiction. Information about registered tax practitioners and complaints is available from the Tax Practitioners Board. These terms do not prevent you from using a lawful complaint or dispute process.
Law and changes to these terms
These website terms are governed by the laws of New South Wales and applicable Australian laws. Courts in New South Wales have non-exclusive jurisdiction, subject to any mandatory right to bring a claim elsewhere.
We may update the website terms and publish a revised review date. Changes do not retrospectively remove accrued rights or vary a professional engagement that requires a separate agreement. If a provision is invalid, the remaining provisions continue only to the extent permitted by law.
